What You Need to Know About Packaging and Labeling Rules 

In 2021, New Mexico took a significant step towards cannabis reform when HB 2, known as the Cannabis Regulation Act, passed both the state House and Senate, paving the way for the legalization of recreational cannabis for adults 21 and older. Governor Michelle Lujan Grisham signed the bill into law on April 12, 2021, officially making New Mexico the 18th state to legalize recreational cannabis and the fifth to do so through legislative action.

 

The new law established the Cannabis Control Division within the Regulation and Licensing Department to oversee the licensing and regulation of cannabis businesses. One of the Division's key responsibilities is setting clear guidelines for the packaging and labeling of cannabis products to ensure consumer safety and product transparency.

Under these regulations, all cannabis products must be packaged in opaque, resealable, and child-resistant containers. Additionally, packaging cannot be designed in a way that appeals to minors. These requirements are crucial to maintaining the integrity of cannabis products and preventing unintended access.

 

Cannabis product labels must also adhere to strict standards and include the following information:

  • The name of the entity that produced the cannabis
  • The manufacturer’s name and license number
  • Net weight of the product
  • Manufacturing and expiration dates
  • Dosage information and usage instructions
  • THC/CBD content, confirmed by lab testing
  • A full ingredient list, including any pharmacologically active ingredients
  • A list of allergens and nutritional information (for edibles)
  • The state track-and-trace system number or product identifier

In addition, the following warning statement must be prominently displayed in bold font:

  • “For use only by adults 21 and older. Keep out of reach of children.”
  • “This product is not approved by the FDA to treat, cure, or prevent any disease.”
  • “FDA has not evaluated this product for safety, effectiveness, and quality.”
  • “Do not drive a motor vehicle or operate machinery while under the influence of cannabis.”
  • “There may be long-term adverse health effects from cannabis consumption, including additional risks for women who are pregnant or breastfeeding.”
  • “BE CAUTIOUS” 
  • “Cannabinoid edibles can take up to 2 hours or more to take effect.”
