How to Stay Compliant With Child-Resistant Packaging Requirements in Maryland

On November 8, 2022, a decisive 67.2% of voters in Maryland gave their approval to Question 4, a ballot measure put forward by the legislature, signaling the legalization of cannabis for individuals aged 21 and older. With this landmark decision, Maryland joined the ranks of states embracing recreational cannabis, becoming the 20th to do so.


The official commencement of legalization occurred on July 1, 2023. Under the new regulations, adults are permitted to possess up to 1.5 ounces of cannabis and are allowed to cultivate up to two plants. Additionally, Maryland's legislation includes specific rules and regulations for the packaging and labeling of cannabis intended for sale.


All cannabis and cannabis products must be in packaging that is plain and opaque, child resistant, and tamper evident in order to be sold to licensed dispensaries. 


Furthermore, all products label must include:


  • Warning statements:
  • "The contents may only be lawfully consumed by a consumer 21 years old or older, or a registered medical cannabis patient."
  • "Consumption of cannabis may impair your ability to drive a car or operate machinery. Please use extreme caution."
  • "There may be health risks associated with cannabis use, especially if pregnant or breastfeeding." and
  • "This package contains cannabis. Keep out of reach of children and animals."
    • Product information including:
  • Finished product lot number
  • Name of the licensee that packaged the product
  • Name, address, and phone number of the licensee that sold the product to report an adverse event
  • Net weight of cannabis or cannabis product
  • An itemization, including weight, of all cannabinoid and terpene ingredients
  • Allergens (if applicable)
  • A list of all non-cannabis ingredients
  • A list of any solvents used to produce the product
  • A nutrition fact panel consistent with the U.S. Food and Drug Administration Standards (edibles)
  • Active and inactive ingredients in descending order of predominance by weight
  • (edibles)
  • Dates corresponding to:
  • (i) The date of harvest, packaging, or production of the product

    (ii) The expiration date or best-used-by date of the product.

  • A certificate of analysis completed by an independent testing laboratory in accordance with COMAR 14.17.08 and the Technical Authority shall be made available on the package through a link or QR code.
  • Universal Symbol

  • Labels mandated by this regulation must adhere to the following specifications. Firstly, they should be either printed directly on the marketing layer or affixed to it through a label or sticker. Secondly, the text utilized must not be smaller than size 6 font or 1/12 of an inch in size to ensure readability. Lastly, all text on the labels must be clearly written and printed in the English language to ensure accessibility and comprehension for consumers. These requirements aim to facilitate clear communication of important information regarding the product to consumers in Maryland's cannabis market.
