How to Stay Compliant With Child-Resistant Packaging Requirements in Missouri

 

In November 2022, Missouri passed Amendment 3 with a 53 percent majority, thereby becoming the 21st state to legalize recreational marijuana. This legislation grants individuals aged 21 and above the authority to purchase, possess, transport, consume, produce, and trade marijuana within the state. The commencement of licensed sales occurred in February 2023. Additionally, the Department of Health and Senior Services is responsible for formulating regulations aimed at guaranteeing the safe utilization of marijuana products, encompassing guidelines concerning labeling and packaging standards.

 

All marijuana products must undergo production, packaging, and labeling procedures designed to safeguard public health and prevent appeal to children. Moreover, except for marijuana seeds and plants, all packaging for marijuana products must be resealable, opaque, and certified as child-resistant. In instances where marijuana products are packaged in multiple containers, the container closest to the product, excluding administration methods or wrappers, must adhere to these specifications.

Furthermore, specific labeling requirements are also outlined as follows:

  • All marijuana products must prominently display "Marijuana" and a red and white universal symbol that consists of the following:
  • A diamond containing the letters "THC";
  • The letter "M" located under the "THC" within the diamond; and
  • For infused products, the number of milligrams of THC in the package, placed directly under the diamond.
  • The closest container to the product must bear labels in a specified order:  
  • ingredients (excluding vague groupings)
  • servings and doses per package for marijuana licensees
  • "best if used by" date
  • originating license number
  • testing licensee
  • track and trace tag number
  • total weight (in grams for certain products)
  • cannabinoid content
  • terpene analysis results (if applicable)
  • usage instructions
  • duration of effects
  • packaging approval number
  • The following warning: "Cognitive and physical impairment may result from the use of marijuana. Keep out of reach of children."
  • Marijuana seeds and plants require clear labeling with "Marijuana" and the universal symbol, along with strain information; additionally, plant packaging should include the propagation date.

All marijuana products must adhere to compliance packaging and labeling standards. Failure to comply with these regulations may result in department sanctions, including administrative penalties of up to five thousand dollars ($5,000) for each product or packaging category found to be in violation of the requirements, identified by approval number.
